AEG’s Jackson death lawsuit schedule for September 2012


One of the civil cases relating to the death of Michael Jackson will
not be heard in court until September 2012, the judge overseeing the
case decided yesterday. By that time the much delayed criminal case
against Doc Conrad Murray should have reached its conclusion, which
could have an impact on this civil suit.
As previously reported, the late king of pop’s mother Katherine
Jackson is suing live music giant AEG Live – promoters of the fated
Michael Jackson ‘This Is It’ residency at the O2 dome in London –
because they paid the fees of Murray, the medic accused of causing the
singer’s death by negligently administering the drug propofol.
Mrs Jackson says that as Murray was hired by AEG to be Jackson’s
personal medic while he worked on ‘This Is It’ they should be held
responsible for his death. There were also allegations that Murray had
been told by AEG bosses to do “whatever it takes” to ensure Jackson was
able to attend rehearsals for his London show, the implication being
that meant pump him full of medication if necessary.
Murray, of course, denies responsibility for Jackson’s demise, and
there are reports his legal reps will claim either Jacko himself, or a
mysterious third party, actually injected the shot of propofol that
caused the singer’s death. Katherine Jackson’s lawyer Kevin Boyle
yesterday admitted the outcome of the criminal trial, now due to take
place this September, will have an impact on the civil case.
In particular, if Murray is found liable for Jacko’s demise, then Mrs
Jackson’s case will centre not on what caused his client’s son’s death,
but on the relationship between AEG and the doctor, specifically
whether the medic was an employee of the live music firm. Boyle added
that if their case did follow a Murray conviction, then any court
hearing in the civil case would be much shorter.
That said, AEG Live’s attorney Marvin Putnam played down the
significance of the criminal trial on this civil case. While, obviously,
an acquittal of Murray would be helpful to AEG, Putnam would argue that
the company’s legal arguments in the civil proceedings – that Murray
was chosen by and reported to Michael Jackson directly, that AEG just
picked up the bills, and therefore wasn’t responsible for his actions –
are strong whatever happens in the Conrad Murray trial this Autumn.
The same LA judge is also overseeing the other civil case relating to
the death of Michael Jackson. His father Joe is suing Murray directly,
of course.

Jackson doctor's lawyers to see footage

Sony Pictures Entertainment has agreed to provide a private screening for Dr Conrad Murray and his defence lawyers to view some 100 hours of raw footage of Michael Jackson's rehearsals for his This Is It concert.

But according to documents filed in court on Thursday they won't be allowed to make public statements about what they see.

A stipulation reached by both sides said that Murray and his lawyers will have access to 21 boxes containing audio-visual recordings of Jackson's rehearsals which became the basis for a concert movie after his death.

Murray has pleaded not guilty to involuntary manslaughter in the superstar's death on June 25, 2009, from an overdose of the anaesthetic propofol and other sedatives. His trial begins in September.

The issue arose when Murray's prosecutors announced they planned to show jurors excerpts from the theatrically released concert movie, Michael Jackson's This Is It, to show Jackson was in good health in the days before his death.

The defence wants to show otherwise. Those lawyers contend scenes showing Jackson in frail health during rehearsals may have been edited out of the movie.

They said there are more than 100 hours of footage from which the movie was derived. Jackson was rehearsing for a planned concert in London when he died. The movie was issued posthumously.

Sony resisted the defence request at first and the company's lawyer, Gary Bostwick, said he was concerned the material would leak out and go viral on the internet.

Superior Court Judge Michael Pastor said at a previous hearing that access to any footage would come with restrictions to prevent it from being disseminated on the internet and elsewhere.

'If Michael Jackson materials are just out there, there could be amazing consequences for Sony and the Jackson estate,' the judge said. 'I'm not inclined to order that they just turn them over.'

The parties later reached agreement.

'Sony has agreed to allow Dr Murray and his counsel to inspect and view the materials in question at a location to be designated by Sony Pictures Entertainment,' the stipulation said.

After the viewing, it said, lawyers will prepare a log of segments they want to obtain for use in Murray's case.

It specified that neither Murray nor his agents or lawyers will make any public statements about 'the content or nature of the materials, their storage, their location or their quality'.

The only issue left for the judge to resolve is who will pay the costs of personnel required for the viewing and copying of segments designated by the defence.

A hearing on the issue is scheduled for Friday but lawyers for both sides indicated in the papers they will ask for the matter to be continued to July 27.

Prosecutors want another delay in the start of the involuntary manslaughter trial of Michael Jackson's doctor, but the judge will wait until next month to decide the request.

"I'm not surprised by all of this," Los Angeles County Superior Court Judge Michael Pastor said during a hearing Friday.

The trial has already been delayed twice since Dr. Conrad Murray invoked his right to a speedy trial after his arraignment in January.

"When I got myself involved in it, I said 'It ain't gonna happen,' " icon_thumbup Pastor said, referring to the original starting date of late March. The case has been "creepy crawly," he said.

Jury selection was under way in May when the defense requested a delay so its expert witnesses could have more time to prepare for new experts hired by the prosecution. Pastor then dismissed hundreds of prospective jurors and rescheduled the trial to start on September 8.

Deputy District Attorney David Walgren said Friday morning that the prosecution needed another three weeks to prepare because of "scheduling issues." Defense lawyers did not object to moving jury selection to the end of September.

Pastor, who said he "rearranged all sort of cases, including capital cases" to start the trial in September, said he would wait until a July 12 hearing to decide.

Also on Friday, the judge approved a plan to allow defense lawyers and prosecutors to view dozens of hours of raw video shot of Michael Jackson's last rehearsals. The video was bought by Sony Pictures for its film "This Is It."

Pastor hasn't ruled on what clips, if any, defense lawyers might be able to show at the trial. He has previously limited the prosecution to just raw video of Jackson's last two days alive.

Saturday is the second anniversary of Jackson's death, which the Los
Angeles coroner ruled was from an overdose of the surgical anesthetic propofol, combined with other drugs.

Murray, who was hired as Jackson's personal physician as he prepared for his comeback concerts in London, is charged in the singer's death.

Jackson's father filed his wrongful death lawsuit against the doc last year, which claims that Murray withheld the singer's medical history from emergency room attendants after Michael was taken to the hospital and initially only admitted to administering three drugs to the "Billie Jean" singer, none of them Propofol.

Joe's lawsuit also states the omission "demonstrated a disregard for Michael Jackson's life" and accuses Murray of giving conflicting statements to police about Michael's drug use.

Conrad's filing claims Michael Jackson had been visiting other doctors who doled out meds to the singer, and that the singer did not provide Murray with his full medical history or an accurate accounting of the meds he was on.

Michael Jackson doctor Conrad Murray court hearing postponed

A scheduled court hearing in Michael Jackson's former doctor Conrad Murray's involuntary manslaughter trial has been postponed.

Murray is accused of contributing to Jackson's death by giving him a lethal dose of propofol and lorazepam.

The next hearing in the case was to take place on July 12, but LA Superior Court judge Michael Pastor accepted a request from both the defence and the prosecutor to delay Murray's court appearance until July 20. The actual trial is to commence in September.

The motion was granted by Judge Pastor so that attorneys on both sides can spend more time analysing raw footage filmed for the posthumously-released concert movie This Is It, The AP reports.

The prosecution claims that the footage will prove that Jackson was in good health in the days leading up to his death, while Murray's defence team contends that deleted scenes from This Is It will exhibit the singer as frail and sickly.

Murray's attorney Nareg Gourjian said that his legal team have already gained "important" information from viewing select clips from hundreds of hours of concert rehearsal footage.

Gourjian explained: "There are about eight to ten different cameras that were recording the rehearsals and each one has different views and different footage. So it is critical that we review the footage from each camera."

Murray has always insisted that he is not responsible for Jackson's death, but could face up to four years behind bars if convicted.

As the courtroom battle ensues in the case against former Michael Jackson doctor, Conrad Murray, new testimonies shed light unto this grim tale.

Yesterday, California courts heard that Jackson threatened to cancel his string of comeback concerts in London unless he was given sleep aides on the day of his death.

As Detective Orlando Martinez took the stand to testify in the preliminary hearing against Murray, he informed the court that he interviewed the personal physician two days after the superstar's death.

According to Martinez, the doctor had been actively administering anaesthetic Propofol to the singer six nights a week for the two months leading up to Jackson's death. According to the Associated Press, Murray claimed he was trying to wean the pop icon off the drug.

Martinez quoted the doctor as saying, "Mr. Jackson began to complain that he couldn't sleep and that he would have to cancel his rehearsal and cancel his shows if he couldn't get any sleep since he couldn't perform."

"It was an injection to get him to sleep and a slow drip to keep him sleeping," Martinez said when referencing the dose of Propofol Murray gave Jackson.

According to the detective, Murray claimed to have left for the restroom after the singer was sleep. He returned shortly after to find Jackson not breathing.

Martinez is one of many witnesses that will be called to testify in these preliminary hearings to determine if the medic should stand trial in the involuntary manslaughter of Michael Jackson.

Film producer and talent manager Bruce Edwin, who was manager of the guitarist of Michael Jackson - David Williams, reportedly announces to press today that he will supplying the courts with information next week concerning Dr. Conrad Murray that should assist in proving his guilt in being complicit in the death of Michael Jackson, the world's biggest star at the time.

Producer Bruce Edwin reveals, "Michael Jackson was the biggest singer and performer of our time, and it is a fact that he had a number of drug pushers around him that wanted him vulnerable and hooked, that attempted to block communication with him from his family and those others that tried to save him, in order to live off his money and get more money."

Bruce Edwin states, "I did not come forward before because first I lost David, and then we lost Michael. It was too painful to talk about. But I will not stand by and let so called doctors who are more concerned with profit than life get away with another murder." He adds, "The pharmaceutical industry is preying on artists, and these unethical doctors are their hit men." Bruce Edwin continues, "We are going to fight for artists and keep on fighting until we do not read about another victim including Michael Jackson, Anna Nicole Smith, River Phoenix, Marilyn Monroe, Kurt Cobain, and countless more."
